Employment quota for persons with disabilities in representative offices: Where do the courts stand?
Since 2023, the Fund for the Social Protection of Persons with Disabilities has started actively filing claims against representative offices for failure to comply with the quota.
This marked a shift from the long-standing (10+ years) practice of applying the Law of Ukraine On the Fundamentals of Social Protection of Persons with Disabilities regarding the obligation of representative offices to meet the quota.
At present, court practice concerning the imposition of sanctions on representative offices is still taking shape.
However, after analyzing available court decisions in disputes between representative offices and the Fund, we can outline several key approaches currently followed by the courts.
