Dismissal for violation of the terms of work with confidential information
By the Law of Ukraine No. 3768-IX as of June 4, 2024, the Labor Code was supplemented with a new ground for dismissal, namely, violation of internal rules of conduct that contain provisions on
1) the obligation of employees not to disclose information with restricted access, as well as
2) conditions for working with confidential information.
Employers previously had the option of including obligations regarding non-disclosure of information and rules for handling confidential information in their internal labor regulations. However, violating such rules could only result in disciplinary action in the form of a reprimand. The dismissal was only possible in the event of systematic violations.
Following the amendments, the Labor Code provides for the possibility of dismissing an employee for a single disclosure of information, as well as for violating the conditions for working with confidential information.
