The Prosecutor’s Office has been restricted in its right to reclaim land plots from bona fide owners, but special confiscation remains in effect

Recent legislative amendments in Ukraine have introduced a 10-year term of limitations for the Prosecutor's Office to initiate claims for land recovery.

Such limitation has a retrospective effect and unlike limitation of action terms has not been suspended for the period of martial law in Ukraine (thus could be applied for lands acquired in 2015 and earlier).

The new law also mandates compulsory compensation to bona fide owners in the event of such recovery, reinforcing legal certainty and the protection of third-party rights.

The amendments do not affect the mechanism of special confiscation within criminal proceedings. Property, including land, may still be subject to confiscation by court order if it is proven to have been acquired through criminal means (e.g., corruption, money laundering).
