Reform of the State Land Cadastre of Ukraine: New opportunities or threats for landowners?

Ukraine is undergoing a major reform of the State Land Cadaster system, aimed at decentralizing land registration, increasing transparency, and improving access to land-related services. The new draft laws No.12453 and No.12454 propose empowering certified land surveyors and local authorities to act as public cadastral registrars, in addition to state cadastral registrars (government officials). This change is expected to reduce bureaucratic delays and simplify the land registration process.

However, the reform raises significant concerns. Delegating registration rights to private surveyors could increase corruption risks, reduce control over registration quality, and create opportunities for land-related abuses. To address these risks, the reform includes safeguards such as mandatory qualified electronic signatures for all cadastral actions, state monitoring of registrars, and the requirement for land surveyors to carry professional liability insurance to compensate for damages caused by mistakes or negligence.

If properly implemented and supported by a functional insurance system, this reform could enhance the efficiency of land management. Yet, without strict oversight, it may create threats to landowners’ rights, including fraud and manipulation of land data.
