Introduction of an electronic office for conscripts, persons liable for military service, and reservists

On April 2, 2024, the President of Ukraine signed the Law of Ukraine “On Amending Certain Laws of Ukraine to Improve the Procedure for Processing and Using Data in State Registers for Military Registration and Acquisition of the Status of Veteran during Martial Law” (the Law), which, among other things, regulates the issue of an electronic cabinet for conscripts, persons liable for military service, and reservists (the Electronic Cabinet). The Law comes into legal force on April 4, 2024.

Thus, the Law of Ukraine “On the Unified State Register of Conscripts, Persons Liable for Military Service, and Reservists” (the Law on the Register) has been supplemented by an article on the Electronic Cabinet:

“The electronic cabinet is a personal cabinet (a protected separate web service) through which a conscript, person liable for military service, or reservist who has undergone electronic identification is provided access to information about his/her personal and service data, as well as services. Electronic identification of a person is carried out using a qualified electronic signature or other means of electronic identification that allow the unambiguous identification of the person”.

First of all, it should be noted that the Law does not contain provisions establishing the obligation to register in the electronic cabinet.

It should be mentioned that the first version of the draft law No. 10449 “On Amending Certain Legislative Acts of Ukraine Regarding Certain Issues of Military Service, Mobilization, and Military Registration” contained provisions on the obligation to register in the electronic cabinet. However, there is information that the Committee of the Verkhovna Rada on National Security, Defense, and Intelligence has rejected such a provision during the preparation of the draft law for the second reading and supported registration in the electronic cabinet as a right, not an obligation. Currently, voting is expected in the Verkhovna Rada of Ukraine on this draft law.

Electronic information interaction between state registers is being implemented. As a result, both the Unified State Register of Conscripts, Persons Liable for Military Service, and Reservists (the Register) and the Electronic Cabinet will be filled with respective information. Therefore, the territorial centers of recruitment and social support will be able to receive information about conscripts, persons liable for military service, and reservists not only from employers, but also from state registers.

The Law introduces the electronic cabinet of the Center for Administrative Services Provision. Among other things, such Centers will be able to provide administrative services at the request of conscripts, persons liable for military service, and reservists regarding updating personal data, considering requests on certain matters within the competence of the territorial centers of recruitment and social support, and issuing necessary certificates and other documents.

The adopted Law provides that the procedure for electronic identification in the electronic cabinet, the list of information displayed therein, and the list of services provided to conscripts, persons liable for military service, and reservists through the electronic cabinet are determined by:

  • The Procedure for Maintaining the Unified State Register of Conscripts, Persons Liable for Military Service, and Reservists, approved by the Cabinet of Ministers of Ukraine on March 28, 2022, No. 94, and/or
  • The Regulation on the Unified State Web Portal of Electronic Services, approved by the Cabinet of Ministers of Ukraine on December 4, 2019, No. 1137 (in the field of national security and defense).

Conscripts, persons liable for military service, and reservists are legally permitted to receive information about their inclusion (non-inclusion) in the Register and information about themselves entered into the Register, including through the electronic cabinet.

It is worth noting that according to Article 6 of the Law on the Register, the following information about conscripts, persons liable for military service, and reservists shall be entered into the Register and stored in the Register’s database: 1) personal data; 2) service data.

List of personal data:

1) Last name, information about changes in last name;

2) First name (all first names), information about changes in first name;

3) Patronymic name (if available);

4) Date of birth;

5) Place of birth;

6) Gender;

7) Place of residence and place of stay;

71) Contact numbers and email addresses;

8) Information about parents (adoptive parents), guardians, caregivers, and other representatives, as well as children (last name, first name, patronymic name (if available), date of birth) – upon the consent of the conscript, person liable for military service, or reservist;

81) Information about the marital status of the person and of his/her family members (last name, first name, patronymic name (if available), as well as children);

9) Details of the passport of the citizen of Ukraine and the passport for travel abroad (series, number, date of issue, issuing authority, validity period);

91) Information about citizenship (change of citizenship);

10) Information about the death of the person or declaration of the person as deceased or recognition of him/her as missing;

11) Information about civil incapacity, recognition of a person as incapacitated (restoration of capacity);

12) Information about employment (identification code and location of the enterprise, institution, organization, place of work, position, work experience);

13) Taxpayer identification number;

14) Digitized image of the person’s face;

15) Information about the date of departure from Ukraine and the date of return to the territory of Ukraine;

151) Information about the person’s movement to temporarily occupied territory of Ukraine (the date and direction);

16) Information about education and area of specialization;

161) Information about the form of education of students of extracurricular, vocational (vocational-technical), vocational pre-higher education, higher, and postgraduate education;

162) Information about work experience in the area of specialization;

17) Information about determination of a person’s disability group, the change of a person’s disability group;

171) Information about the results of medical examinations conducted to determine fitness for military service;

18) Information about bringing to criminal responsibility (notification of suspicion of committing a criminal offense);

19) Information about bringing to criminal responsibility on the basis of a court conviction that has entered into force;

20) Information about the presence (absence) of a criminal record;

21) Unique record number in the Unified State Demographic Register;

22) Information about the status of a veteran;

23) Information about proficiency in foreign languages;

24) Information about permission to store and carry weapons;

25) Information about participation in qualification upgrade programs, retraining;

26) Information about documents issued for departure for permanent residence abroad, stay abroad for permanent residence, or return to Ukraine;

27) Driver’s license details (series, number, date of issue, issuing authority, validity period, category);

28) Details of license of tractor driver / machine operator (series, number, date of issue, issuing authority, category);

29) Qualification certificate details of a member of the ship’s deck crew for inland waterway shipping, other qualification document confirming professional competencies for safe operation of inland waterway vessel, international certificate for the right to operate a pleasure craft, small vessel / water scooter operator certificate, other document entitling to operate a pleasure craft, small vessel, water scooter (series, number, date of issue, issuing authority, validity period, qualification);

30) Aircraft pilot license (series, number, date of issue, issuing authority, validity period, category);

31) Information about a person who has gone missing under special circumstances;

32) Information about internally displaced person;

33) Information about the right to deferment from military service during mobilization.

List of service data:

1) Information about the performance of military duty;

2) Information about the results of medical examination (military medical examination);

3) Information about the completion of alternative (non-military) service in accordance with the Law of Ukraine “On Alternative (Non-Military) Service”;

4) Information about participation in combat operations.
