Personnel records management during the war

On March 24, 2022, the Law of Ukraine "On organization of labor relations under martial law" came into force. The Law establishes the specifics of the regulation of labor relations under martial law. In particular, Article 7 of the Law provides the employer with the opportunity to simplify personnel records management.

This provision doesn`t cancel the obligation of the employer to draw up and store personnel documents during martial law, but only allows employer to do this in accordance with its own rules. In other words, the employer shall comply with the usual rules established by labor legislation, and only if this is necessary to deviate from them and act at its own discretion. The employer, for example, may suspend the maintenance/execution of certain documents or determine a simplified procedure and means of communication between the employee and the employer for a period of martial law.

The possibility of conducting simplified personnel records is provided only for companies that are in the areas of active hostilities.
