Search for persons liable for military service: Which court should handle the case?
A new category of disputes has been emerging in Ukraine’s judicial practice – challenges by persons liable for military service against administrative searches.
As is known, information about such searches is entered by the Territorial Recruitment and Social Support Centers into the Oberig Register and forwarded to the police to ensure the delivery of persons liable for military service to such Territorial Centers.
The first decisions of district administrative courts appeared in spring 2025.
However, since mid-2025, a new trend has taken shape: some courts have ruled that such challenges should be brought before local general courts rather than district administrative ones.
In our new article, we analyze the roots of this issue, the emerging court practice, and the implications of this legal uncertainty.
