On August 28, 2025, the Law of Ukraine “On Particularities of Regulation of Activities of Legal Entities of Certain Organisational and Legal Forms in the Transitional Period and of Associations of Legal Entities” will be put into effect. As of this date, the Commercial Code of Ukraine shall no longer be in force. Although the new law has already been in force for over six months, some issues related to the transformation of enterprises remain unresolved. Many businesses are still unsure \u2013 is it really worth stepping into such a complicated and unclear transformation process?<\/p>\n

At present, there are no official clarifications on the matter, leaving businesses in a state of uncertainty, and this lack of clarity is causing concern. A cautious approach \u2013 where enterprises are not rushing into transformation \u2013 appears to be reasonable, as there is still sufficient time to make a well-considered decision.<\/p>\n

Such caution is fully justified in this situation. This time should be used to analyze the potential consequences of transformation, taking into account the specific nature of each enterprise\u2019s activities. There is also hope that official guidance on transformation for the private sector will be provided in the near future.<\/p>\n
